Maximizing Your Experience with Optional Practical Training (OPT)

Are you an international student studying in the United States and looking to gain valuable work experience after graduation? The Optional Practical Training (OPT) program might be the perfect opportunity for you. We’ll explore everything you need to know about OPT, from its purpose and eligibility criteria to the application process and benefits.

Understanding OPT

Optional Practical Training (OPT) is a temporary employment authorization program that allows international students on an F1 visa to gain practical work experience in their field of study. It provides an opportunity for students to apply the knowledge and skills they have acquired in the classroom to real-world work environments, enhancing their professional development and competitiveness in the job market.

Eligibility Criteria

  • Maintain valid F1 student status.
  • Complete at least one academic year of study.
  • Obtain a job offer or be actively seeking employment directly related to their field of study.
  • Apply for OPT before completing their academic program or within 60 days of graduation.

Application Process

  • Request a Form I-20 with OPT recommendation from your designated school official (DSO).
  • Prepare and submit Form I-765 (Application for Employment Authorization) to U.S. Citizenship and Immigration Services (USCIS), along with the required documents and application fee.
  • Wait for USCIS to process your application and issue an Employment Authorization Document (EAD), which grants you authorization to work in the United States under OPT.

WORKING REGULATIONS

  • Authorized Employment: OPT allows F1 visa holders to engage in temporary employment directly related to their field of study in the United States.
  • Types of Employment: OPT participants can work in a variety of employment arrangements, including paid employment, unpaid internships, and self-employment. However, the employment must be directly related to the student’s major area of study.
  • Duration of Employment: During the initial 12-month OPT period, students can work full-time (more than 20 hours per week) or part-time (up to 20 hours per week). There are no restrictions on the types of jobs or industries students can work in during this period.
  • Unemployment Limit: OPT participants are allowed a maximum of 90 days of unemployment during the initial 12-month OPT period. Students should track their periods of employment and unemployment carefully to ensure compliance with this requirement.

Staying Compliant: Fulfilling Reporting Obligations Throughout Your OPT Journey

OPT participants are required to fulfill certain reporting requirements throughout their OPT period to maintain compliance with U.S. immigration regulations. These reporting requirements typically involve updating their designated school official (DSO) with any changes in their employment status, address, or personal information within specified timeframes.

Failure to comply with reporting requirements can result in the termination of OPT authorization and jeopardize the participant’s legal status in the United States. Providing guidance on how to fulfill reporting requirements and highlighting their importance in maintaining legal status can be beneficial for OPT participants.
